Welcome to 9Lives. By accessing or using our platform, you agree to be bound by these Terms of Service. Please read them carefully before using our services.
Acceptance of Terms
By creating an account, accessing, or using the 9Lives platform ("Platform"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Platform.
These Terms constitute a legally binding agreement between you and 9Lives Inc. ("9Lives," "we," "us," or "our"). We reserve the right to modify these Terms at any time, and such modifications will be effective immediately upon posting. Your continued use of the Platform following any changes constitutes acceptance of those changes.
Eligibility Requirements
To use the 9Lives Platform, you must meet the following eligibility requirements:
Age Requirement
You must be at least 18 years of age or the age of majority in your jurisdiction, whichever is greater, to create an account and use our services.
Legal Capacity
You must have the legal capacity to enter into binding contracts. If you are using the Platform on behalf of a business, you represent that you have authority to bind that entity.
Account Accuracy
You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate and complete.
User Accounts & Responsibilities
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:
- Immediately notify us of any unauthorized use of your account or any other breach of security
- Not share your account credentials with any third party or allow others to access your account
- Ensure that you log out from your account at the end of each session when using a shared device
- Take responsibility for all activities and transactions that occur under your account
- Not create multiple accounts for the purpose of circumventing our policies or gaining unfair advantage
Platform Services
9Lives provides a marketplace platform connecting independent sellers with buyers. Our services include:
Marketplace Access
Access to our online marketplace where sellers can list products and buyers can browse, discover, and purchase items from independent creators and boutique brands.
Seller Tools
Tools and features for sellers to create and manage their online stores, including AI-assisted product listings, inventory management, and analytics.
Payment Processing
Secure payment processing services through our trusted third-party payment providers, enabling safe transactions between buyers and sellers.
Customer Support
Support services to assist with platform navigation, dispute resolution, and general inquiries for both buyers and sellers.
Seller Obligations
If you use the Platform as a seller, you agree to the following additional obligations:
- Only list products that you have the legal right to sell and that comply with all applicable laws
- Provide accurate descriptions, images, and pricing for all listed products
- Fulfill orders promptly and ship products within the stated timeframe
- Respond to buyer inquiries and provide reasonable customer service
- Comply with all tax obligations and maintain accurate business records
- Not engage in any fraudulent, deceptive, or illegal practices
- Maintain product quality standards and honor your stated return policies
Buyer Obligations
If you use the Platform as a buyer, you agree to the following obligations:
Accurate Information
Provide accurate shipping information and payment details for all transactions. You are responsible for ensuring delivery addresses are correct.
Payment Obligations
Complete payment for all purchases made through the Platform. All sales are final unless otherwise stated by the seller's return policy.
Good Faith Conduct
Engage with sellers in good faith, provide honest reviews, and use the dispute resolution process appropriately without abuse.
Intellectual Property
The 9Lives Platform, including all content, features, and functionality, is owned by 9Lives Inc. and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works of any Platform content without our express written permission.
Sellers retain ownership of their original content, including product images and descriptions they create. By posting content on the Platform, you grant 9Lives a non-exclusive, worldwide, royalty-free license to use, display, and distribute such content solely for the purpose of operating and promoting the Platform.
Prohibited Activities
You agree not to engage in any of the following prohibited activities:
Fraudulent Activity
Any form of fraud, including but not limited to fake listings, fraudulent chargebacks, identity theft, or misrepresentation of products or services.
Prohibited Items
Listing or selling counterfeit goods, illegal items, weapons, adult content, or any items prohibited by our Community Standards or applicable law.
System Abuse
Attempting to hack, disrupt, or circumvent the Platform's security measures, or using automated systems to scrape data or manipulate Platform functions.
Off-Platform Transactions
Attempting to conduct transactions outside the Platform to avoid fees or circumvent buyer protections is strictly prohibited.
Limitation of Liability
To the maximum extent permitted by law, 9Lives shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising out of or related to your use of the Platform.
Our total liability for any claims arising under these Terms shall not exceed the greater of: (a) the amount you paid to 9Lives in the 12 months preceding the claim, or (b) $100 USD. Some jurisdictions do not allow limitations on liability, so these limitations may not apply to you.
Governing Law & Disputes
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.
Any disputes arising from these Terms or your use of the Platform shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, unless you opt out within 30 days of accepting these Terms by emailing contact@9livesmarketplace.com.
